Comprehensive privacy notice

This is a translation of the Spanish privacy notice issued under Mexican law. In case of discrepancy, the Spanish version prevails.

1. 01Identity and address of the data controller

   ORANGE MONITOR ("Orange Monitor"), with address at Calle Conquistadores 105, interior PA 07, colonia Mirasierra, C.P. 66240, San Pedro Garza García, Nuevo León, México, is responsible for processing your personal data in accordance with Mexico's Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP), published in the Official Gazette of the Federation on March 20, 2025, and other applicable regulations.

   For any matter related to your personal data, write to us at contact@orangemonitor.com.

2. 02Personal data we process

   We only process the data needed to assist you:

   • Identification and contact data you send us by email: full name, company or organization, role, phone number, email address, country and city, topic of interest and any information you choose to include in your message.
   • Technical browsing data: IP address, browser and device type, pages visited, date and time of access (hosting server logs), approximate country derived from the IP address, and your region and language preference.

   We do not request sensitive personal data; please do not include it in your messages. This website is not directed at minors.

3. 03Purposes of processing

   Purposes necessary for the relationship you request (they do not require your consent):

   • Handling and answering your information or contact requests.
   • Following up on proposals, quotes or services you request from us.
   • Operating, maintaining and protecting this website, including preventing misuse and ensuring information security.
   • Remembering your region and language preference and suggesting the version of the site that matches your location.

   Secondary purposes, which require your consent: sending you information about Orange Monitor solutions, events or news, and producing internal statistics on interest in our services.

   If you do not want your data processed for secondary purposes, tell us at any time by writing to contact@orangemonitor.com. Declining will not prevent us from handling your request.

4. 04Transfers and processors

   We do not sell, rent or assign your personal data. We may rely on service providers acting as processors (for example, website hosting and email services) who process data only on behalf of Orange Monitor, for the purposes of this notice and under confidentiality and security obligations. Some of these providers may store information on servers located outside Mexico.

   We will only transfer your data to third parties without your consent in the cases provided by the LFPDPPP, for example when required by a competent authority or when necessary to establish, exercise or defend a right in legal proceedings. We do not carry out transfers that require your consent.

5. 05Options to limit the use or disclosure of your data

   You may ask us at any time to limit the use or disclosure of your data by writing to contact@orangemonitor.com. If your request is appropriate, we will add you to our internal exclusion list.

   You may also register with the Public Registry to Avoid Advertising (REPEP) of Mexico's Federal Consumer Protection Agency (PROFECO).

6. 06ARCO rights and withdrawal of consent

   You have the right to access your personal data, rectify it if it is inaccurate or incomplete, cancel it when you consider it is not required for the purposes of this notice, and object to its processing for specific purposes (ARCO rights). You may also withdraw any consent you have given us.

   To exercise them, send your request to contact@orangemonitor.com including:

   • Your name and a means to send you our reply.
   • Documents proving your identity or, where applicable, the identity and authority of your legal representative.
   • A clear and precise description of the personal data and the right you wish to exercise.
   • Any other information or document that helps locate your data.

   We will reply within a maximum of 20 business days from receipt of your request and, if it is appropriate, we will carry it out within the following 15 business days. The reply will be sent through the same channel in which we received your request.

   If you believe your right to personal data protection has been violated, you may contact Mexico's Ministry of Anti-Corruption and Good Governance (Secretaría Anticorrupción y Buen Gobierno), the competent authority.

7. 07Cookies and similar technologies

   This website only uses technical cookies and local storage that are necessary for it to work:

   • OM_LOCALE: remembers the region and language you chose (duration: 1 year).
   • OM_GEO: stores the approximate country of your connection to suggest the right version of the site (duration: 24 hours).
   • Browser local storage: remembers your language preference and whether you closed the region suggestion.

   We do not use advertising cookies or third-party tracking tools. You can delete or block these technologies in your browser settings; the site will keep working, although it may not remember your language preference.

8. 08Security and retention

   We apply administrative, technical and physical security measures to protect your data against damage, loss, alteration, destruction or unauthorized use, access or processing. We keep your data only for as long as necessary to fulfil the purposes of this notice and applicable legal obligations; afterwards, we delete it securely.

9. 09Visitors from other countries

   If you contact us from the European Union, the United Kingdom, Brazil or another jurisdiction, in addition to this notice you may exercise the rights granted by your local data protection law (for example, the GDPR, UK GDPR or LGPD) by writing to contact@orangemonitor.com. We process your contact data because you ask us to and in order to answer your request.

10. 10Changes to this privacy notice

    We may update this notice to reflect legal changes or changes in our services or privacy practices. Any change will be published on this page with its update date and, if a change requires your consent, we will ask for it by email when we have your address.

11. 11Acceptance

    By sending us your data by email, you acknowledge that you have read this privacy notice. You may withdraw your consent at any time as described in the ARCO rights section.
